When school is out in San Francisco, Oakland, and Berkeley, owners and relatives can potentially move in. Although Owner Move-In and Relative Move-In Evictions (OMI/RMI) are prohibited during the school year, classes will soon be dismissed.

With the school's summer break upon us, there is a short window of time for owners to exercise their right to recover possession of a rental unit to use it as their principal place of residence or lay out the welcome mat to qualified relatives.

San Francisco, Oakland, and Berkeley have all enacted ordinances that protect educators and minor-age children in the household from no-fault evictions during the school year. These ordinances are meant to provide stability for school employees, allowing them to focus on their educational duties without the disruption of having to find new housing and to avoid the trauma of displacing young minds, as well.

Yet the school session will soon end.

These types of evictions will come with a host of procedural requirements and relocation payments, but our office can shepherd you through this process. The main point we want to impart is that with the school year put in a state of suspense, there are new opportunities for owners and their relatives, as well as new buyers looking to purchase a tenant-occupied property.

If you find that an OMI/RMI is an attractive option, time is of the essence, before school returns.

When owners are cast into the unenviable position of informing tenants that the status quo of the property has changed and that the household will need to find new surroundings through no fault of their own, it is always an uneasy conversation. It can especially tug at the heartstrings when there are educators and children involved.

We pay homage to all dedicated school employees doing an outstanding job. As parents, we recognize that transitioning children out of their surroundings may require a bit of hand-holding. Informing the household that there is a change in the status quo of the property may be a difficult conversion to broach but one that can be made easier with proper counsel.

The law has attempted to weigh the need to keep educators and children implanted against the rights of property owners. Together, we can perform this delicate balancing act.

To explore the possibilities, share some details about your situation.
