Contra Costa Board of Supervisors usher in its own iteration of an eviction moratorium

Through May 31, 2020, landlords cannot terminate a tenancy for failure to pay rent, so long as the tenant demonstrates the failure to pay rent is "directly related to a loss of income or out-of-pocket medical expenses associated with the CODIV-19 pandemic or any local, state, or federal government response to the pandemic."

A common theme in other locales that have implemented eviction bans is vagueness on what type of documentation should be produced by the tenant when substantiating a COVID-19 related hardship, but Contra Costa County spells out with greater specificity what "adequate documentation" is required.

Notably, Contra Costa County anticipates that family members may hunker down together and certain family members may not be included in the original lease. The Board of Supervisors has told landlords they cannot evict if immediate family members who might otherwise be considered unauthorized occupants reside in the rental unit.

Related and also noteworthy, the emergency ordinance allows owner move-in and relative move-in evictions, so it seems there is a priority placed on family ties.
