Let’s talk about instances when a landlord does not have keys to the property they own
In many cases, an owner does not have keys to the property they own. This can be because they inherited the property, purchased a foreclosed property with occupants in it, or for whatever reason, they can't get entry.
When owners do not have keys to the unit, one strategy we like to use is calling up a locksmith to prefabricate a locking system and inform the occupants that within a few days, they will be delivered a new set of keys.
In this diplomatic fashion, the owner is not performing a “lockout.” They are merely receiving a new set of keys to gain access to the unit. After proper notice, the locksmith can change the locks, but the tenant cannot claim landlord harassment or an illegal eviction because, in fact, the tenant has the keys to enter.
Also note that if tenants change the locks on their own, it constitutes a just cause for eviction and if landlords are playing this cat-and-mouse game, it’s best to consult an attorney because rental property owners should always have access to their properties and obstruction is a problem.
