Q: I obtained a writ of possession in an eviction action and the Sheriffs are scheduled to do a lockout, but I am out of town. In my absence, can my relative show up at the prescribed time?


Yes. Have the relative show the paperwork. At the day and time of the lockout, be sure that someone is standing on the sidewalk with a locksmith or someone capable of changing the locks. Get there half an hour early.

However, notify the Sheriff's office before the lockout and explain that there will be someone else in your stead.

Keep a good distance from the property and let the deputies do their job. Once the lockout is effectuated, be aware of specific legal obligations regarding the tenant's personal property left behind; it's not finders keepers.
